Serious Injury Motorcycle Accident Cases Are Complex Litigation - Part 1

In the United States, about 4,000 motorcyclists die on the highways every year. Traffic accidents injure another 67,000 motorcyclists annually in this country. Many survivors of motorcycle crashes suffer serious injuries that require hospitalization, surgery, and long-term medical treatment. Victims often, never fully regain their ability to return to work or resume family responsibilities.

Even if a motorcycle accident victim fully recovers, the accident can take its toll. An individual may lose time and income from work, need help with household chores, and have to cope with the pain of injuries and necessary medical treatments.   • Get the name, address, and telephone number of the other driver(s).

  • Get the drivers license number(s) of the other driver(s).

  • Take down the vehicle owner's name and address, if the driver does not own that vehicle.

  • If it is leased or rented, write down the name, address, and telephone number of the rental company.

  • Give the other driver(s) your name, address, driver's license number and insurance information.

  • Look around the accident scene to locate all possible witnesses to the accident. Ask for their names, addresses, and telephone numbers (home, cell, and work). If the witnesses do not want to get involved, write down their automobile license plate numbers and the states where the license plates were issued.

  • Listen carefully to comments that the other driver(s) make about events leading up to the accident, such as "I didn't see you," and write down their comments.

Call the police, or have someone else call them immediately. Generally, the police officer will interview all the drivers and any witnesses at the accident scene. The police may also collect vital physical evidence and record the location of skid marks, highway signs and markings, and debris from the accident. All this information is critical to "reconstruction" of the accident, to determine the speed of each vehicle, the point of impact, and the person responsible for the accident.

Ask the police officer to find out where the other driver was going. If the driver was traveling on a work assignment, you may have legal claims against both the careless driver and his or her employer. If you did not go to the emergency room right after the accident, see a doctor as soon as possible. It is very important to get a check-up, because you may not be able to tell how badly you are hurt right after an accident. Be sure to follow all the doctor's instructions about further medical care, tests, treatment, or restrictions on your activity.

After a serious accident, the at-fault driver or his/her insurance company may try to take advantage of an injured victim. To avoid this, follow these guidelines:


  • Do NOT get into an argument with the other driver(s) about what happened.

  • Do NOT sign any statements or documents about the facts of the accident.

  • Do NOT have your bike repaired. Wait until you have an attorney who will get your bike photographed and inspected, notify the other driver's insurance company, and show it the damage to your motorcycle.

  • Do NOT answer questions from an insurance company or from an attorney representing the other driver.

  • If your own insurance policy requires you to report your accident within a certain time, get an attorney to help you with this as well.

After an accident, it is essential to consult a Michigan motorcycle accident lawyer immediately. In important ways, the legal claims of a Michigan motorcyclist are different -- and more complicated -- than the claims of an automobile driver, because Michigan law does not consider a motorcycle to be a "motor vehicle."

Motorcycle accidents, as any personal injury attorney will tell you, are usually deadlier than car accidents. Whereas a car can help shield a motorist from injuries, the only protection a motorcycle rider really only has a safety helmet - if he or she is in fact wearing one - to prevent serious injury.

In my personal injury law practice in Seattle, Washington, I see my share of tragedy that comes as a result of riding the roads on two wheels instead of four. I would like to share some somber statistics on motorcycle accidents and caution bikers to be extra cautious when traveling.

• The number of accidents increases regularly year-to-year in the U.S.
Motorcycle deaths are 30 times as great as for those who drive automobiles
• Riders under 40 are 36 more times as likely to be in an accident fatality than other drivers who are the same age
Motorcycle riders over 40 are around 20 times more likely to be in an accident fatality than other drivers who are the same age
Motorcycle fatalities make up about 5 percent of all highway deaths, but motorcycles represent only 2 percent of all registered vehicles in the U.S.
• Approximately 80 percent of motorcycle accidents result in personal injury or death. Car accidents? Only 20 percent.
• Most motorcycle accidents are caused by the simple fact that other vehicles fail to see them
• Weather is not a factor in 98% of motorcycle accidents
• 92% of motorcycle users involved in accidents have no safety or riding training; instead they learned on their own or from friends. Motorcycle rider safety training has been shown to significantly reduce personal injury and wrongful death in traffic mishaps.
• The typical motorcycle accident allows the operator only 2 seconds to take action to avoid a harmful collision
• In 73% of all motorcycle accidents, the rider is not using any eye protection (safety goggles, for example) and diminished vision resulting from wind delays critical reaction time to danger
• The use of a safety helmet did not cause any significant failure to hear traffic noises or create a limited field of vision that contributed to a motorcycle accident
• Riders and passengers using helmets suffered significantly lower head and neck injuries.

These statistics clearly show that motorcycle usage can be significantly more dangerous than driving a car. They also clearly show that taking the right safety steps, such as wearing a helmet, having eye protection and getting some professional motorcycle safety training, can help bikers travel much more safely.

Motorcycle Laws in Different States

Different states in the US follow different motorcycle helmet laws that cater to their own residents and constituents. Motorcycle helmet law has been instituted to provide safety and protection to motorcycle riders from different states.

But the helmet law being followed in one state may not be the same as those followed in another. There are even other states that do not have their own laws governing the proper use of motorcycle helmets. There are currently 4 states that do not have their own motorcycle helmet law.

These are Colorado, Illinois, Iowa, and New Hampshire. Of the other 46 states, 20 of them follow full helmet law for all riders in their territory to follow. They are Alabama, California, Georgia, Louisiana, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Nebraska, Nevada, New Jersey, New York, North Carolina, Oregon, Tennessee, Vermont, Virginia, Washington and West Virginia. But each of these states' motorcycle helmet laws may have differing definitions on what constitutes a safety helmet.

In the other remaining states, 19 have helmet laws that exempt adult riders. These are usually those riders who are 18 years old and over. These are the states of Alaska, Arizona, Connecticut, Delaware, Hawaii, Idaho, Indiana, Kansas, Maine, Minnesota, Montana, New Mexico, North Dakota, Ohio, Oklahoma, South Dakota, Utah, Wisconsin and Wyoming.

There are seven states that require adult bikers at the ages of 18 and 20 to still wear helmets while riding their motorcycles. These states are Arkansas, Florida, Kentucky, Pennsylvania, Rhode Island, South Carolina, and Texas.

It is on these states that some bikers think that they are being discriminated upon because of the requirement for riders between 18 and 20 years old. But some motorcycle riders just would want to rid themselves of having to don their helmets while riding their motorcycles. But these riders should realize that helmets are there for their safety and protection.

Bankruptcy law may be more relevant to your personal injury case than you realize. This article briefly examines the interaction of bankruptcy law and personal injury judgments from the perspective of the judgment debtor and the personal injury plaintiff debtor.

If you have been awarded a personal injury judgment, the defendant may decide to file bankruptcy in an attempt to discharge liability for the judgment. In other words, an individual or corporate defendant might opt to file bankruptcy instead of satisfy your judgment if the balance tips in favor of bankruptcy. This may occur if the defendant was uninsured or underinsured for the judgment (like an uninsured driver in a car accident case), and the defendant has so few assets that they can be completely protected in a bankruptcy. There are some exceptions to discharge of personal injury judgments, however. Similarly, in some jurisdictions, personal injury awards are a form of disposable income you must submit to the Trustee in a Chapter 13 bankruptcy. If there is even a chance you could receive a personal injury award, it is imperative that you notify your bankruptcy lawyer of this possibility so he or she can assess whether bankruptcy is truly appropriate for you. Otherwise, you risk seizure of the judgment which will relieve the pressure of your medical and other bills.

Bankruptcy law is more complicated than most personal injury suits, so it would generally be inadvisable to use the same attorney for both purposes. Your bankruptcy and personal injury lawyers should be able to work together to maximize your financial gain.

Airbags involve the rapid deployment of a large cushion at speeds that can exceed 230 mph. The entire deployment and inflation process is about 0.2 sec. Airbags deploy in about 0.05 second. A vehicle changes speed so fast in a crash. Therefore, air bags must inflate rapidly if they are to help reduce the risk of the occupant hitting the car’s interior.

Newer airbags trigger at a lesser speed. Still passengers must remain at least 10 inches from the bag to avoid injury from the bag in a crash. While airbags can protect a person under the right circumstances, they can also injure or kill. Protect yourself and your passengers from unnecessary injuries or even deaths.

Airbags produce more than 1200 lbs of force. Activated air bags can inflict severe eye injuries, including blindness, abrasions of the skin, hearing damage (from the sound during deployment), head and facial injuries, and breaking the fingers, hands or arms. The most common injuries are bruising of the eye socket and bleeding in the eyeball. Some of these victims go on to develop angle-recession glaucoma, or pressure in the eye due to rips in the eye's drainage system. Glaucoma can slowly destroy vision. The number of eye injuries from air bags may be rising. Pipe smoking should be avoided while driving. If the airbag inflates and hits the pipe, it is likely to be fatal, even in a moderate crash.

In 1990, the first automotive fatality attributed to an airbag was reported. Deaths peaked in 1997 at 53 in the United States. The National Highway Traffic Safety Administration reports that since 1990, airbag deployment has killed 227 people in low-severity crashes.

Serious or even fatal injuries can occur when someone is very close to, or in direct contact with an air bag module when the air bag deploys. Such injuries may be sustained by unrestrained or improperly restrained occupants who slide forward in the seat during pre-crash braking, unconscious drivers who are slumped over the steering wheel, and properly restrained drivers who sit too close to the steering wheel.

Children under 12 should always be restrained in a rear seat. A rear-facing infant restraint should never be put in the front seat of a vehicle with a front passenger air bag. Such a restraint places an infant's head close to the air bag module.
